Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Scan Code Pro platform, including our web applications, APIs, mobile experiences, and related services (collectively, the “Service”). By using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.
1. Accounts & Eligibility
- You must be at least 18 years old to create an account.
- Account credentials are confidential. You are responsible for safeguarding access tokens and passwords.
- We may suspend or terminate accounts that violate these Terms or pose security risks.
- Users must provide accurate information and keep billing details current.
2. Acceptable Use
You agree not to use the Service for unlawful, deceptive, or abusive purposes, including but not limited to:
- Generating QR codes that link to malware, phishing sites, or fraudulent offers.
- Storing or transmitting personal data without appropriate consent or legal basis.
- Attempting to reverse engineer, probe, or disrupt the Service or its infrastructure.
- Misrepresenting affiliation with Scan Code Pro or using branding without permission.
We reserve the right to review content and remove codes that violate these standards or applicable law.
3. Subscription Plans & Payment
- Fees for paid plans are billed in advance on a monthly or annual basis through our payment processor, Stripe.
- Subscriptions renew automatically unless canceled before the renewal date.
- All fees are non-refundable except where required by law. Downgrades take effect at the next billing cycle.
- We may adjust pricing with at least 30 days’ notice. Significant changes will be communicated via email or in-app alerts.
4. Service Availability & Support
- Scan Code Pro targets 99.5% uptime per calendar quarter for paid plans.
- Planned maintenance windows will be announced in advance whenever practicable.
- Business plan customers receive priority support with a four-hour initial response SLA.
- We may modify features or discontinue parts of the Service with reasonable notice.
5. Data & Privacy
Our Privacy Policy describes how we collect and use data. By using the Service, you consent to those practices.
- You retain ownership of content you upload or generate. You grant us a limited license to host, display, and analyze it for the purpose of providing the Service.
- We implement industry-standard safeguards to protect data. However, no method of transmission is completely secure, and you use the Service at your own risk.
- You are responsible for complying with privacy laws that apply to you, including informing end users about data collection.
6. Intellectual Property
Scan Code Pro and its licensors retain all rights, title, and interest in the Service, including software, logos, and trademarks. You may not copy, modify, or create derivative works without prior written consent.
7. API Usage
- API clients must authenticate using keys issued by Scan Code Pro.
- We may impose rate limits or revoke access if usage threatens platform stability or violates policy.
- API integrations must respect user permissions and consent when accessing personal data.
8. Disclaimers & Liability
- The Service is provided “as is.” We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
- To the fullest extent permitted by law, Scan Code Pro is not liable for indirect, consequential, or incidental damages.
- Aggregate liability is limited to fees paid in the twelve months preceding the claim.
9. Termination
You may terminate your account at any time from the billing dashboard. We may suspend or terminate access if you breach these Terms, fail to pay fees, or if continued access poses risk to the Service or other users.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, excluding conflict of law principles. Disputes will be settled through binding arbitration in San Francisco County unless both parties agree to an alternative forum.
